1. Acceptance of Terms

By accessing or using the Zambezi Cup website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Tournament Registration & Participation

2.1. Eligibility: Participants must be members of a Pro Golf League or join us to participate in the tournament.

2.2. Registration: All registrations are subject to availability and approval by the Zambezi Cup organizing committee. Submission of a registration form does not guarantee acceptance.

2.3. Entry Fees: Entry fees are non-refundable except in cases where the event is cancelled by the organizers. Partial refunds may be issued at the discretion of the organizing committee for cancellations received more than 60 days prior to the event.

2.4. Code of Conduct: All participants must adhere to the Rules of Golf as established by the R&A and USGA, as well as any additional rules specified by the Zambezi Cup organizing committee.

3. Intellectual Property

3.1. All content on this website, including text, graphics, logos, images, and software, is the property of the Zambezi Cup Foundation and is protected by international copyright laws.

3.2. You may not reproduce, distribute, modify, or create derivative works from any content without prior written consent from the Zambezi Cup Foundation.

4. User Accounts

4.1. If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2. You agree to provide accurate and complete information during registration and to update such information to keep it current.

5. Donations & Financial Contributions

5.1. All donations made through this website are processed securely through our third-party payment processor.

5.2. The Zambezi Cup Foundation is a registered 501(c)(3) nonprofit organization. Donations may be tax-deductible to the extent allowed by law. Donors should consult with their tax advisors regarding deductibility.

5.3. Donation refunds are generally not provided. In exceptional circumstances, refund requests may be considered on a case-by-case basis.

6. Liability & Indemnification

6.1. Assumption of Risk: Participants in Zambezi Cup events acknowledge that golf and related activities involve inherent risks, including but not limited to physical injury and property damage.

6.2. Limitation of Liability: The Zambezi Cup Foundation, its directors, officers, employees, and volunteers shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in events or use of this website.

6.3. Indemnification: You agree to indemnify and hold harmless the ZambeziCup Foundation from any claims, damages, or expenses arising from your violation of these Terms or your use of our services.

7. Media & Photography

7.1. By participating in Zambezi Cup events, you consent to being photographed, filmed, or otherwise recorded, and grant the Zambezi Cup Foundation the right to use such images for promotional, educational, and charitable purposes.

7.2. If you wish to opt out of photography consent, please notify the organizing committee in writing prior to the event.

8. Modifications to Terms

The Zambezi Cup Foundation reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services following any changes constitutes acceptance of the modified terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
